International Women’s Day Referral Promotion Terms and Conditions

PROMOTION OVERVIEW
1. The International Women’s Day Referral Promotion (“the Promotion”) is organised and sponsored by HelloGold Sdn. Bhd. (Company No. 1170189-H) (“HelloGold”). The Promotion is governed by these terms and conditions, including any subsequent amendments thereto (“Terms & Conditions”).
2. All Participants in the Promotion will be deemed to have accepted the Terms & Conditions.
PROMOTION PERIOD
1. The Promotion will run from 8th March 2021 to 11:59:59pm on 31st March 2021 (“Promotion Period”). HelloGold reserves the right to shorten or extend the Promotion Period without prior notice.
ELIGIBILITY
1. The Promotion is open to all HelloGold Basic and PRO users (“HelloGold Customer”).
2. A HelloGold Customer who fulfils the eligibility criteria and chooses to participate in the Promotion shall be deemed the referrer (“Referrer”).
PROMOTION MECHANICS
1. The Referrer can share their referral Promotion code with as many people they would like (“Referred Users”).
2. The Promotion is only valid when the Referred Users:
  1. registers for a HelloGold PRO Account,
  2. applies the referral Promotion code they receive, and
  3. makes their first purchase of RM50 worth of gold or more, in one single transaction within the Promotion Period (“Successful Referral”).
3. The Referrer with the most number of Successful female Referrals within the Promotion Period will win ONE Mystery Prize worth RM350 (“Winning Referrer”).
4. ONE lucky female Referred User who has been successfully referred by the Winning Referrer also stands to win ONE Mystery Prize worth RM350 (“Winning Referred Female User”).
5. Each Referred User is entitled to use only ONE referral Promotion code and/or Promotion code within their lifetime as a HelloGold customer. For the avoidance of doubt, if a Referred User has claimed their reward of gold using any other code previously, the Referred User is not eligible to use any other code to claim another reward in gold.
6. Any Referred User who registers for a HelloGold PRO Account:
  1. before the Promotion Period and makes a purchase of RM50 worth of gold or more during the Promotion Period; or
  2. during the Promotion Period and makes a purchase of RM50 worth of gold or more after the Promotion Period;
will not be eligible to win the Promotion Mystery Prize but are still entitled to receive the RM5 worth of gold in accordance with the existing Terms and Conditions for Referral Promotion.
1. Any Referred User who has a HelloGold PRO Account for more than 30 days is not eligible to participate in this Promotion.
REWARDS AND PRIZES
1. Promotional benefit:
  1. Referrer:
    1. Will receive a RM5 gold reward (“Bonus Gold”) for every Successful Referral completion within the Promotion Period; and
    2. Stand to win a Mystery Prize giveaway worth RM350 (“Prize”).
  1. Referred User:
    1. Will receive a RM5 gold rebate (“Rebate Reward”) upon completing a Successful Referral within the Promotion Period; and
    2. Stand to win a Mystery Prize giveaway worth RM350 (“Prize”).
1. The Referrer with the highest number of Successful female Referrals will win ONE Prize and ONE of their successful female referred friends will also win ONE prize.
2. The Winning Referred Female User will be randomly selected either manually or by computerized means at HelloGold’s sole and absolute discretion.
3. The Winners will be announced on 5 April 2021 and will be notified by call and e-mail to coordinate the delivery of their prizes. HelloGold will not be liable for any failed notifications due to third party systems errors and / or users unsubscribing from HelloGold’s email list and / or turning off app notifications.
4. There is no limit to the amount of Bonus Gold that the Referrer can receive when their Referred Users make their first RM50 purchase or more, in one single transaction.
5. If the Referred User purchases double the amount needed to get the rebate, the Rebate Reward will remain the same value as per the Promotion benefits at that particular time.
6. The Bonus Gold and Rebate Reward will be reflected in the user’s main HelloGold account as at the time the Successful Referral transaction occurs.
7. All gold earned using the referral Promotion code can be withdrawn or redeemed based on HelloGold’s terms and conditions in effect at that point in time.
8. HelloGold reserves the right to substitute the rewards and Prizes for other rewards of equivalent value without prior notice to the Participant, at its absolute discretion.
9. HelloGold reserves the right to disqualify any Participant from receiving the rewards and Prizes, at its sole discretion, if the Participant does not comply with the terms and conditions of this Promotion or HelloGold’s main product terms and conditions, policies and/or operating procedures.

DISCLAIMER
1. The participants understand and agree that their participation in the Promotion is at their own risk and HelloGold is not liable to any person whether in tort, contract, statute or otherwise for any direct, indirect, incidental or consequential damages or costs in connection with their participation in the Promotion.
2. HelloGold makes no representation or warranty whatsoever pertaining to:
  1. the continuous, uninterrupted and error-free operation of the Promotion;
  2. the accuracy of information and statements in the Promotion page; Facebook page and ads with external approved partners;
  3. the security and freedom from any computer viruses or other harmful properties.
3. HelloGold reserves the right to amend these Terms and Conditions, the mechanics or processes of the Promotion at any time without any prior notice and the Participants shall be bound to such amendments.
4. HelloGold will not be held accountable for any loss of property during the Promotion.
5. HelloGold reserves the right to retract, change, amend and/or postpone the Promotion in the event of any unforeseen circumstances deemed necessary.
INTELLECTUAL PROPERTY RIGHTS
1. The Referral Promotion and all information published and related to it (including text, graphics, symbols, icons, software and trademarks) are protected by copyright and trademark and remain the sole property of HelloGold.
PERSONAL DATA
1. HelloGold collects personal identifiable information to provide services or to correspond with the participant. This information is stored in a manner appropriate to the nature of the data by HelloGold and is used to fulfil the participant’s request(s). By submitting the participant’s personal information, HelloGold deems that permission is given by the participant to HelloGold and/or its authorised agents to use this information for the purpose of present and future marketing and promotional purposes and to improve its products and services. If the participant informs HelloGold via the Careline at [email protected] that the above information should not be used as a basis for further contact, HelloGold will respect the participant’s request. The participant’s information will not be provided or shared with other companies or partners for their independent use.
FORCE MAJEURE
1. HelloGold shall not be liable for any default in respect of the Referral Promotion due to any act of God, acts of Government, war, riot, strike, lockout, industrial action, fire, flood, storm, technical or system failures or any event beyond the reasonable control of HelloGold.
GOVERNING LAW
1. The Terms and Conditions are governed by the laws of Malaysia.
